冠英:拆庙行动违宪 Guan Eng: Temple demolition unconstitutional


民主行动党秘书长林冠英抨击雪州政府,强硬拆除林芭再也木屋区印度庙的野蛮行为,这也是国阵政府过于强大的后遗症。

他说,上述事件显示雪州政府不尊重法律赋予人民宗教信仰自由的权利,也质疑在拆除一间座落在私人地段上的印度庙,须出动4个地方政府的执法人员及警方。

林冠英今日下午连同大山脚区国会议员章瑛、怡保东区国会议员古拉、民主行动党雪州主席欧阳捍华及副主席陈彼得等,视察日前遭地方政府拆除的印度庙后,强烈谴责州政府的野蛮行为。

“州政府有责任照顾人民权益,事先应为信徒另觅土地后才拆庙,而不是为了少数人的利益,牺牲多数人的利益”

他抨击雪州大臣拿督斯里莫哈末基尔在此事上,采取不理不睬的态度。

他说,国大党全国拿督斯里三美威鲁以一个部长级的身份向首相求情,仍无法阻止此事的发生,一再推翻所谓“有人在朝好办事”的说法。

●大山脚区国会议员章瑛对于州政府以强硬手段拆庙表示遗憾,并吁请当局日后须谨慎处理各民族的宗教敏感问题。

她促请首相关注少数民族的权益,加上回教教义劝导教徒须协助少数民族,因此现在是回教徒言行一致之时。

●怡保东区国会议员古拉说,本身今早在国会提出的紧急动议遭议长驳回,但仍会在下星期二的国会上再次提出该动议,希望获得其他议员的支持。

他说,国家并无任何条文阐明庙宇不可建在私人地上,所以目前是讨论该课题的最佳时机,而不是继续将问题藏在地毯下。

他希望雪州政府严正看待此事,取消当地的私人发展计划,以及批准该庙永久建立在原地上。

●民主行动党雪州副主席陈彼得说,执法单位向民众动粗事件一再发生,警方应向民众作出一个明确的交代,以免事件不了了之。

他也抨击执法人员不尊重他人神明,强行毁坏他人宗教的神像。

DAP Secretary-General Lim Guan Eng criticized that the actions of Selangor State Government to demolish the Hindu temple in Kampung Rimba Jaya were barbaric behaviors.

“This shows that the temple demolition by the State Government is against the Article 11 of the Federal Constitution which guaranteed freedom of religion in the country."

Together with Guan Eng were MP for Bukit Mertajam YB Chong Eng, MP for Ipoh Barat YB M.Kulasegaran, DAP Selangor State Chairman Ean Yong Hian Wah and Vice Chairman Peter Tan. They condemned the barbaric actions of the State Government to demolish the temple.

“State Government has the responsibility to defend the people's rights. They should not sacrifice the interests of the majority of people just for the sake of the minority.”

YB Chong Eng, MP for Bukit Mertajam expressed her deepest regret towards the demolition of Hindu temple by the State Government. She urged the authorities to be more sensitive when dealing with religions in the future.

YB M.Kulasegaran, MP for Ipoh Barat said that he had raised an urgent motion on this issue in the Parliament House but it was rejected by the Dewan Rakyat deputy speaker. He would propose the motion again on the coming Tuesday.

Kulasegaran described the demolition as "an extreme act which is unconstitutional, criminal, despicable and unrelenting."

He said, there is no provision clarifying that the temple can not be built on private land, so it is the best time to discuss the issue, rather than continue to sweep another issue of great public importance under the carpet.

He hoped that the Selangor State Government would look at this matter solemnly, and try to suspend the private development projects, as well as to ratify the permanent establishment of the temple.



DAP Selangor State Vice Chairman Peter Tan said, the police should make a clear explanation publicly on the repeated violence of the police against the people.

He also criticized that the authorities did not respect the religions of the people, and they even damaged the religious statues.
